Terms & Conditions of Sale: Used Machinery 4 Sale

IMPORTANT NOTICE: WE DO NOT DISCUSS WARRANTY CLAIMS OR ISSUES OVER THE PHONE.

ALL COMMUNICATIONS REGARDING MECHANICAL ISSUES MUST BE SUBMITTED IN WRITING VIA EMAIL.

1. Bespoke Delivery & On-Site Inspection Service

Not a "Sight-Unseen" Sale: We provide a bespoke delivery service so that buyers do not have to travel. This is not a standard distance sale; it is a "Delivery for Inspection" service.

The Handover Process: Our driver will wait while you perform a full mechanical test and inspection.

 

By allowing the driver to leave and keeping the machine, you are formally "Accepting" the goods as being of satisfactory quality and fit for your specific purpose.

Conclusion of Sale: The contract is deemed concluded at your premises only after you have inspected and tested the machine. Therefore, the 14-day "cooling-off" period for distance selling does not apply once the machine has been tested and accepted on-site.

Rejection upon inspection at customer's premises: If you are not happy upon inspection, the driver will immediately reload the machine. You will be refunded the machine cost in full, minus the pre-agreed delivery/transport service fee.

2. Acceptance via Representatives & Couriers

Authorised Representatives: If the buyer is not present at the time of delivery or collection, any person acting on their behalf (including family members, employees, or friends) is deemed to have full authority to inspect, test, and legally accept the machine on the buyer’s behalf.

Third-Party Couriers: If the buyer sends a third-party delivery company or courier to collect the machine, that courier acts as the buyer’s Identified Recipient. Possession passes to the buyer the moment the machine is loaded. By sending a courier, the buyer voluntarily waives their right to a personal inspection.

Binding Signatures: Any signature provided by a courier, driver, or representative is legally binding and confirms the machine has been accepted in its current condition.

3. Returns & "Diminished Value" Protection

No Returns for User Error: We do not accept returns for issues caused by a lack of operator knowledge. If a machine is returned and found to be user error (e.g., incorrect starting procedure, safety interlocks, flat battery), the buyer will be charged a £150 inspection fee plus all transport costs.

Diminished Value Fees: If a return is requested after the driver has left, we will deduct a minimum of 25% (up to 50%) from any refund to cover "Diminished Value," cleaning, re-stocking, and additional hours/wear.

Professional/Business Use: Any buyer purchasing for a farm, estate, landscaping business, or any professional/commercial use acknowledges this is a Business-to-Business (B2B) transaction. B2B sales have no right of return once the machine is accepted.

4. Equipment Condition & Maintenance

Non-Refurbished Status: All machinery is sold as Used Equipment.

We do not refurbish. Expect dents, knocks, and aesthetic wear.

Required Equipment: Buyers must possess a battery charger, full tool kit, and grease gun. Good mechanical knowledge is a requirement for purchase as used machinery requires constant maintenance.

Standard Settings: Machines are supplied in a standard factory setting. It is the buyer's sole responsibility to adjust the machine (height, tension, tracking) to their individual needs.

5. User Competency & Training (Buyer's Risk)

Assumption of Risk: All machinery is operated at the buyer’s own risk.

Private Use of Commercial Gear: If a private individual buys a commercial machine, they sign this to confirm they have had relevant training and are completely competent in the mechanical workings and setup of said machine.

We accept no responsibility for injury or damage caused by an incompetent user.

6. Warranty Coverage & Exclusions

Scope of Warranty: Coverage is strictly limited to major mechanical failure of the engine or gearbox. Major failure is statistically rare; the vast majority of issues are related to wearing parts or ancillaries, which are not covered by any warranty.

Specific Ancillary Exclusions: The warranty strictly does not cover batteries, starter motors, alternators, or fuel-related issues (clogged injectors, pumps, or contaminated fuel).

Wearable & Maintenance Items: There is no warranty on tyres, punctures, belts, pulleys, blades, all bearings,

deck bearings, or tracks.

Warranty Periods: 3-Month (Private) / 1-Month (Commercial) Engine & Gearbox only. (Return to Base).

Strictly NO Warranty:

 

Attachments, Trailers, Toppers, Trailed Gangs, Buckets, PTO-driven equipment, or 3-point linkage items.

Hardware Exclusions: Missing clips, bolts, pins, bushes, catches, tie-downs, brackets, rubbers, hangers, springs, glass, radios, and aircon are excluded.

7. Warranty Claims & Transport

All warranty claims are "Return to Base" at the buyer's expense. Transport assistance is £1 per mile (round trip).

Claims must be emailed with photos/video to sales@usedmachinery4sale.co.uk.

We respond within 72 hours. DO NOT CALL US.

8. Final Agreement & Right to Cancel

If you are not comfortable with our terms, please do not sign and we will happily terminate the sale. Do not go ahead unless you completely agree to these terms.

 

Do not collect or accept delivery unless you are 100% happy with your purchase.

All equipment remains the property of Used Machinery 4 Sale until paid for in full.

Our descriptions are guides, please make sure your

 

completely satisfied on delivery or collection.

 

Our drivers will happily wait while you test the machine.
